The man convicted last month of murdering Jay Boughton is asking for a new trial or to be acquitted of the charges.

Last month, a jury found Jamal Smith guilty of first-degree murder and second-degree murder in Boughton’s death. Boughton was fatally shot while driving home from a baseball game on Highway 169 last summer. Smith’s attorneys say the trial didn’t have evidence supporting Smith’s convictions. Prosecutors denied those claims and asked for the judge to deny Smith’s motions for acquittal or a new trial. Smith is currently scheduled to be sentenced in October.  A first-degree murder conviction carries a mandatory sentence of life in prison.
