According to the criminal complaint: On January 8, 2025, at about 1:20 a.m., officers from the Mankato Department of Public Safety were dispatched to a disturbance at a Mankato residence. Devon J Stewart was reportedly inside the residence with a knife. Stewart told the victims that he was not going to leave the residence and did not have to leave the residence “per the law.” The Victims tried to physically remove Stewart. Stewart pushed away Victim 2 hurting their back on a piece of furniture. The Victims stated that Stewart was drunk.

Stewart left the scene on foot. Victim 2 immediately called 911. At about 4:30 a.m., Stewart was located sleeping in the vestibule of a Mankato building. Inside the vestibule there was an overwhelming odor of alcohol. Officers woke up Stewart who became immediately confrontational. Stewart physically pushed the two officers who were trying to place him in a squad car. Once at the jail, Stewart placed himself on the ground. Stewart refused to use his legs and officers had to pull him up. Stewart told one of the officers the he was going to “kick his ass out.” Officers noted a strong odor of an alcoholic beverage from Stewart. Stewart had slurred speech and watery/bloodshot eyes. Officers concluded that he was intoxicated.

Stewart demanded and then refused a PBT several times.
